NEW HANOVER COUNTY, NC (WWAY) — After serving for nearly two decades as district attorney for New Hanover and Pender Counties, Ben David announced he is resigning next year.

Earlier this week, David shared he would leave office on September 3.

“This date is not arbitrary,” David wrote in a news release. “Vacating the office at least 60 days before Election Day on November 5, 2024 will ensure that the people of the Sixth Prosecutorial District will get to decide who occupies this position next.”

On Wednesday, David shared with WWAY that he isn’t resigning to run for office in 2024, to leave the Cape Fear Area, or because there is something wrong.

“In fact, it’s just the reverse. It’s never been better and that’s exactly why I should be leaving,” David said. “This office is such an important thing. There’s 50 people who work here and we advise 1200 officers with 20 different police agencies. This office will still be here when I leave and the career public servants in it will too. This is the right time for a PEACEFUL transfer of power.”

Through his lengthy career, he says he’s most proud of the people he has hired and the public servants working in his office.

As for a legacy he hopes to leave behind, he says it would be that crime is best fought by building community.

“We’re going to put people in prison who have done terrible things; rape, murder, armed robbery, child molesters, of course and as long as possible. But the vast majority of people who come through the criminal justice system either have bad problems with drugs and alcohol or they’ve made bad choices. Frequently, they’re young people who hung out with the wrong crowd,” David said. “To really get to the root causes of trying to take care of childhood trauma and not have people become tomorrow’s defendant who are today’s victim because we’re helping them now as victims. It means we’re stopping the revolving door of recidivism.”

For much of his career, David has worked closely with his twin brother, Jon David, who serves as the district attorney for Brunswick, Bladen, and Columbus Counties. A partnership that Ben says has greatly helped the administration of justice in the Cape Fear.





“What we try to say is bad guys don’t respect jurisdictional boundaries. So when people are playing cat and mouse across the Cape Fear River, going from New Hanover into Brunswick County for example, or between Pender and Bladen or going out to Columbus. All that stuff is still violent crime, it’s still drug trafficking, it’s still literally traffic that we have to take a regional approach to solving,” he said.

While Ben David plans to step down in 2024, he says he’s heartened to know that  his brother  will still be serving just across the river and hopes he will continue to do so for years to come.

As for the cases that have come across his desk and have been heard in his courtroom, he says some have been the first of their kind as science and technology continue to advance.

“Whether we’re talking about cell phone technology pinpointing people’s locations, ShotSpotter data letting us know where guns went off, mitochondrial DNA that convicted people sometimes two and a half decades later. All of these things have happened because we never forgot that science is necessary to do our jobs,” David said. “Just as we can use science to solve cases and prove them beyond a reasonable doubt, I believe we can use science to prevent cases from ever occurring if we understand that childhood trauma is the number one gateway drug to the opioid epidemic, if we understand that childhood trauma leads people to pick bad relationships and join gangs. If we love on our children and we really take care of them, we’re stopping crime tomorrow.”

Looking ahead, although David doesn’t know who will be serving as the district attorney for the Sixth Prosecutorial District this time next year, he leaves voters with what he believes is one very important qualification.

“I truly think the person who sits in this seat should be a prosecutor and not merely a politician,” David said. “The test is this — if the person you love most on this earth were taken by a crime of violence tonight, who would you want going to the crime scene to advise local law enforcement and then giving a closing argument in that courtroom? The answer to that question will be who my successor should be.”

Even though he will not be serving as district attorney, David says he will never stop fighting for people and giving victims a voice. He says whatever is next for him will still involve a law license and a courtroom.

There’s a less-than-one-in-a-million chance of being struck by lightning in any given year. 

Brunswick County District Attorney Jon David used that analogy five years ago, after the arrest of the Southport police chief Gary Smith and his top lieutenant for wage theft. 

“Lightning has struck three times here in the 13th district,” he said after a press conference announcing their arrests. David had already prosecuted the police chiefs of Boiling Spring Lakes and Fair Bluff at the time.

Since then, David has prosecuted yet another police chief and a sheriff. That brings the total list of high-ranking law enforcement officials he’s pursued to at least six. 

(Meanwhile, the record for real-life strikes in a lifetime is seven.)


The previous DA, Rex Gore, had served for two decades but lost the primary that year. By 2013, Gore pleaded guilty to a misdemeanor charge related to approving $14,000 in false travel expenses for his assistant during his time in office. 

The first police chief investigation for David came soon after taking office, when former Boiling Spring Lakes Police Chief Emmett Ballree pleaded guilty to charges stemming from allowing his son, a convicted felon, to fire a fully automatic, silent submachine gun at a law enforcement firing range in 2011.

Next, David oversaw the conviction of former Fair Bluff Police Chief Marty Lewis for drug trafficking while on the job. In 2015, a judge sentenced Lewis to up to 10 years in prison. 

Then came Southport police chief Smith and his second-in-command, Michael Simmons, who were both arrested in 2018 for collecting public paychecks while operating a separate trucking business when they were supposed to be working.

Last year, Chadbourn Police Chief William Anthony Spivey allegedly faked his own death to escape charges of stealing money, drugs, and guns from the evidence locker over the years. In September, Spivey struck a plea deal with David’s office and will spend at least 11 years in prison.

And earlier this month, The Assembly and the Border Belt Independent revealed that federal investigators are pursuing a potentially sweeping investigation into abuses of power involving the Columbus County Sheriff’s Office (read a teaser below). Dozens of people have been subpoenaed in an active investigation that appears to focus on disgraced sheriff Jody Greene, and possibly his former top aide, Joseph Herring.

David didn’t return requests to comment on the sixth (or seventh, if Herring is also prosecuted) lightning strike in his district. 

Meanwhile, David’s twin brother, Ben, hasn’t seen as much action during his 19-year tenure as the district attorney for New Hanover and Pender counties.

Ben David’s assistant, Samantha Dooies, said he hasn’t ever had to prosecute a sitting police chief or sheriff. But in 1999, as assistant district attorney, David helped prosecute Atkinson Police Chief John Lewis Cowan, who was convicted on charges related to stealing money from people he had arrested. 

“The case unearthed widespread corruption in the force and the agency was disbanded,” Dooies said.

A 2016 study of police crime, the first of its kind, concluded that they are not isolated incidents or uncommon events. It found the rate of arrest to be about 7 for every 10,000 nonfederal sworn officers–so, far likelier than getting struck by lightning.

As we just mentioned, a federal grand jury investigation examining the conduct of former Columbus County Sheriff Jody Greene is underway, and at least six sheriff’s deputies, one local police chief, and the chairman of the county Board of Commissioners have been called to testify. 

The subpoenas indicate that what started as an investigation into a recorded phone call in which Greene said he wanted to fire Black deputies seems to have ballooned into something much bigger.

The Assembly and the Border Belt Independent found that while the full extent of the investigation isn’t yet clear, some of the lines of inquiry include claims that Greene had sex on duty with a subordinate, intimidated county commissioners, and sought to have perceived political enemies criminally charged.

When the Sheriff Gets it Wrong

In mid-August, Cape Fear Academy, a private school in southern New Hanover County, sent out a message to parents announcing two things: first, the school had secured a school resource officer from the New Hanover County Sheriff’s Office; second, Randy Johnson was retiring from his position as director of security after three years to “seek other opportunities.”

The timing wasn’t an accident. 

WHQR found that Sheriff Ed McMahon told the school that Johnson, his former deputy, was in violation of state law forbidding weapons on school campuses. McMahon refused to assign a deputy to the school unless Johnson was disarmed.

Johnson protested that he was legally allowed to carry under both state and federal law, but the school didn’t challenge the sheriff. Johnson resigned, saying that carrying a firearm had been intrinsic to the job description when he accepted the position. He also said that he would have felt unsafe being unable to defend himself or students without a firearm. Johnson told WHQR he felt his hand had been forced. 

The thing is, McMahon was wrong. Johnson was allowed to carry his weapon.

WHQR unpacks how McMahon ended up giving the school incorrect advice and why Johnson feels the move was retaliatory. The story also surrounds a confusing legal analysis–which comes from the North Carolina Sheriffs’ Association, a powerful lobbying group that McMahon has helped lead for years.
